Fire at a furniture retailer – Australia: Insurer denied cover for an insured peril at an insured’s premises citing improper operating activities. The claim calculation prepared acted as the basis for the loss determination in relation to loss of profits and additional increased costs of working. It was further argued that the denial of cover by the insurer caused further consequential losses by the insured. Again, the loss model prepared served as the basis to calculate these additional losses. Court ruled that cover was applicable and the insurer was to pay all losses based on the calculation submitted.

Fire at resources company – Australia: Insurer denied cover for a multiple of items claimed. Loss model was prepared and additional supporting documentation provided to substantiate the operating parameters/loss variables included in the claim. Court accepted loss calculation and substantiation for the loss sustained. Further ruling provided on policy interpretation and used the loss calculation to settle the loss between the parties.
